Welcome to Tiny Comet! We're excited to have you here. Before you start enjoying our games (“Game”), website and related services that we provide (collectively the “Service”), please take a moment to read and understand our Terms of Service ("Terms"). These Terms govern your use of the Service.
The Service is provided to you by Tiny Comet, Inc. (“Tiny Comet”). By accessing or using the Service, you agree to these Terms in their entirety. If you do not agree to these Terms, please refrain from using the Service.
Please note that parts of the Service operate on the Roblox platform, which is provided by the Roblox Corporation (“Roblox”). Your use of the Roblox platform is additionally subject to the Roblox Terms (as defined below). The Tiny Comet Service is an independent service that is not affiliated with, endorsed by, or otherwise connected to Roblox. The terms ROBLOX and any other Roblox material such as the Roblox avatars are the property of Roblox.
1. Acceptance of Terms
By accessing or using the Service, you confirm that you are of legal age in your jurisdiction to consume the Service or, if you are not, that you have obtained the consent of your parent or legal guardian to use our Service and agree to these Terms.
If you are a U.S. or Canadian resident, you also agree that disputes with Tiny Comet must be resolved on an individual basis through final and binding arbitration in accordance with Section 9 (“Dispute Resolution”).
2. Your right to use the Service
Subject to your compliance with these Terms and any supplemental policies of Tiny Comet and the Roblox Terms (as defined below), you have a limited, revocable and non-exclusive right to enjoy the Service for your own non-commercial purposes. You must not copy, modify, adapt, translate, create derivative works based on, display, publicly perform, publish or commercially use the Service except as expressly otherwise provided herein.
If you purchase any in-game items in the Service (“In-Game Items”), you have the right to use such In-Game Items subject to these Terms and the Roblox Terms, within the Game or in case of Roblox avatar accessories, within the Roblox platform. You may also have the right to use and trade the In-Game Items within the Game. The In-Game Items cannot be traded outside of the Service or exchanged or traded for cash or anything else of real-world monetary value.
Your use of the Service is in addition subject to the Roblox Terms of Use, the Roblox Community Standards and any other policies, terms and guidelines introduced by Roblox from time to time (collectively the “Roblox Terms”). Please study the Roblox Terms carefully.
You understand and agree that the Service is constantly evolving. Accordingly, Tiny Comet may update or modify the Service or discontinue parts of it in the normal course of business and this may have an impact on your use of the Service. This may include removal or modification of In-Game Items. Your use of the Service may be contingent on your acceptance of the modified Service.
3. Discord Community Guidelines
We provide a link to our Discord community where users can interact with one another. To ensure a safe and enjoyable experience for all users, we have established Community Guidelines and Rules. By participating in our Discord community, you agree to adhere to these guidelines, which are published in the Discord channel.
4. User Conduct
When using the Service and participating in our community, you agree to:

5. Intellectual Property
All content on the Service, including but not limited to text, graphics, images, videos, and trademarks, is owned by or licensed to Tiny Comet and is protected by copyright and other intellectual property laws.
6. Modifications to the Terms
We reserve the right to modify or update these Terms at any time. You are responsible for reviewing these Terms regularly. For any material modifications we strive to provide you with prior written notice through the Service. Your continued use of the Serviceafter any modifications constitutes your acceptance of the updated Terms.
7. Termination
We reserve the right to terminate or suspend your access to the Service, at our discretion, without notice, for any suspected or actual violation of these Terms or the Roblox Terms. We also reserve the right to suspend or terminate the Service if we believe that it might create a risk of legal liability or if we have reason to believe that the Service is infringing on third party rights.
8. Disclaimer and Limitation of Liability
The Service is provided on an "as is" basis without warranties of any kind, express or implied, including but not limited to and to the fullest extent permitted by applicable law the warranties of merchantability, fitness for a particular purpose, title, non-infringement, and those arising from course of dealing or usage of trade. While we strive to provide accurate and up-to-date information, we do not guarantee the accuracy, completeness, or reliability of any content on our Service.
To the fullest extent permitted by applicable law: (i) Tiny Comet is not responsible for any indirect, consequential, special, punitive or similar damages, including loss of business, profits or data and whether or not Tiny Comet has been advised of the possibility of such damages; and (ii) the maximum liability of Tiny Comet is limited to 100 United States Dollars.
Nothing in these Terms is intended to limit your statutory rights that you may have under law or limit or exclude liability or warranties not possible in certain jurisdictions. Therefore, some of the above disclaimers may not apply to you.
9. Dispute Resolution
In the event you and Tiny Comet are unable to resolve your dispute amicably on an informal basis, then, except as provided below, you and Tiny Comet agree to submit any dispute to final and binding arbitration pursuant to the Federal Arbitration Act. The arbitration will be conducted before a single neutral arbitrator in accordance with the rules of JAMS and the Federal Arbitration Act. This means you and Tiny Comet agree to give up the right to resolve the dispute in a trial before a judge or jury. The arbitrator shall determine the scope and enforceability of this agreement to arbitrate, including whether or not the dispute is subject to arbitration and shall rule on any defense, that the claim(s) in question is exempt from this arbitration agreement.
You and Tiny Comet agree that any arbitration under these Terms will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted, including claims as a plaintiff or class member in any putative class, collective and/or representative proceeding, such as in the form of a private attorney general action against the other. Further, unless both you and Company agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
This arbitration agreement does not apply to claims that are subject to a small claims court of competent jurisdiction. Further, any action by Tiny Comet regarding your actual or alleged infringement of an intellectual property rights, any action in which Tiny Comet seeks equitable relief or any other action that may not be submitted to arbitration under applicable law will be subject to the jurisdiction of the courts located in San Francisco, California.
10. Applicable Law
Any dispute arising out of or related to these Terms, the Privacy Policy, or the Service shall be governed in all respects by the laws of the State of California, USA without regard to conflict of law provisions. The United States Federal Arbitration Act applies to the interpretation and enforcement of the agreement to arbitrate and no class actions provisions of Section 9 above.
